I don't think this is 100% factual. I've got citations based on what others saw and as long as they're willing to give a statement and testify (should it come down to that) a citation can indeed be issued. If someone knows for sure this is incorrect feel free to correct me but I received a driving under suspension citation when I was young based on someone seeing me driving my car.

Everyone can sit here and talk about California or whatever state's law until you are blue in the face. It means nothing. Each state's laws are different.

The only thing that is pertinent is what the laws are in the state of Colorado. If you think going to court just to tell the cop what you think of him is going to be advantageous in any way...think again. That will prove nothing and might very well get you larger fines and other things such as driving school that you wouldn't of had otherwise.

If you truly want to fight this in court, you need to educate yourself. The biggest thing is what was the actual reason for the stop. I highly doubt it will be anything such as a specific decible reading. In Florida a car can be stopped if it has an exhaust system that sounds louder than factory.......ie anyone can say it sounded louder than factory to them.(but this is Florida and shouldn't be read to apply to your situation)

My guess would be the fact that he stopped you before, you told him then you didn't have a muffler or whatever, it sounded the exact same this time, so he stopped you. Or something as easy as the law here in Florida.

Of course it could be something other than that. I don't know. Assuming it's the exhaust....you need to research Colorado law to see if the exhaust alone would be reason enough for a stop. It would be here...but again that means nothing to you.

You might have a chance if an exhaust violation is not a primary reason to effect a traffic stop but it was the reason the cop used. That kind of thing. Walking into court just to say something like police harrasment or whatever is going to be a waste of your time and possibly money.

Research the laws to see if you really have a leg to stand on. You should be able to do a simply google search on state law and look up the actual laws that were cited.
