Here is the response from the Dept of Consumer affairs:

Mr. Auerbach,

Good morning. I received a response from PEP. I have been speaking with Tom
Emerson the General Manager.
You should be receiving a check in several days. Mr. Emerson stated it should
be mailed by tomorrow, Thursday, Jan. 22, 2004, the latest. The check will be in
the amount of $1,550.00. I have faxed the breakdown of the costs and PEP's
letter of explaination to Peter Sanchez. PEP has charged you with a Custom Order
Cancellation fee of $399.00 and deducted your multiple order discount of
$191.00.

I will send you a hard copy of the letter, and breakdown of charges, via U.S.
mail. Should you decide to pursue other avenues to recover the balance of your
payment, I will include information about filing a small claims lawsuits

My order was never built and never shipped by PEP. This is an erroneous fee!

Multiple order discount deduction?

Now this one is the most rediculous one I ever heard of. I was given a discount on my order as an incentive to bring PEP future business. PEP never said anything about having to pay them back the discount if I failed to bring them customers. Since, I haven't received my suspension kit, how could I possibly recommend their business to anyone, anyway?

These deductions were taken off my advance payment for a suspension kit that was never built and never shipped. I asked for a full refund months ago as I am entitled to by law and they refused.

These people are crooks! Plain and simple.

As for you Sandman, you should be ashamed of yourself just sitting back and allowing your business associates to steal my money! Don't you have any guilt at all?

Sucks man

Charing a "restocking" fee for something never shipped or even stocked is a load of crap.

Just keep calling them and harassing them for the rest of your life. You learned a lesson and protected the rest of the community from these dirtbags. Job well done!

it totals about 600 bucks. i never cease to be amazed that a company would commit business suicide for 600 bucks. do they think they will ever get another order from anyone who reads this board?

sheer stupidity. even if they think they are 110% percent right, this is not the way to prosper in the modern business world for a small business that specializes in selling limited run parts.

hey PEP... whether you are right or wrong the way you handled barbell makes everyone who reads about it suspicious of you. enjoy the money you'll never see from me :wink:

Yup, I gotta agree.

I've sat back and watched the entire PEP & ATD pony show.
Pretty sad ending if ya ask me.

PeP won't be in my checkbook either.

JS has got to be the best front setup going.
Built for a SyTy owner for SyTys and nothing else.

I hear competition eng rear ladder bar setup is another option that should be far more customer friendly.
Could be the next "best thing"...

If it were me, I'd just pay PEP a visit and dump buckets of paint on their cars or something silly like that. Then, you can let them know what its like to be waiting to drive your vehicle for some time like your sy/ty has been down (waiting for parts).

I am kinda "renegade" though, so this may not be the best option.

PEP could have avoided this with simple honesty and fact. Instead this is how they handle it. I still sincerely hope they never recoup their investment. This company was portrayed to be so different from Dustan but how different are they really??????????????????

So glad I waited on Jeff.....

BTW Jeff am I ever getting my suspension???? :wink: :wink:

At this point you have two options.. Cash the check or file a small claims case which will either mean you hire an attorney or fly down... In which point you still might need to fly down anyways, however you might be able to recoup the costs if you also sue for damages (time, stress, plane ticket) ... Be aware though if you cash the check you have no recourse..

Doesn't matter.. THe company portrayed the item as in stock and ready to ship.. There was no express agreement stipulating that the product being sold would not ship immediately, in fact PEP stipulated that the item was to be shipped within a couple weeks, hence PEP had to ship the product within 30 days or give him the option of receiving ALL of his money back... It's been a lot longer than 30 days hence PEP has absolutely no grounds to stick Adam w/ a cancelation fee...

I agree 100%,but it's not like Adam or anybody in this GP fiasco are dealing with a reputable company.I'm just saying,if it was me,I'd be THRILLED to get some of my money back.

I can't see how they charged you $191. The regular price is $2199, they sold it to you for $1999. The refund should be based on $1999 plus shipping, where does the additional multiple order fee come from. Did you order another item that was discounted?

As for custom order, they told you it was ready to ship for a full month after you paid them, its not you fault they can't produce the item as promised and furthermore the lying about it being shipped (they did that tactic with me for 2 weeks as well, and the 4 weeks prior saying would be shipped any day now) The item is listed on their website and as far as I know, they have 3 other rear suspension kits, Sandman has 2 and BG old truck had one.

As you you mentioned before they tried to charge you a restocking fee on an item they did produce. I would try to be as calm as possible and call back the state attorney, further explain the situation. This is a bunch of BS, PEP is obviuosly dragging their feet as long as possible and trying to get as much money as possible. I am sure anyone with a Brain will realize this is probably the suspension PEP sells unless Sandman buys another SyTy....

i suggest that we sit on this for a couple of days and you do nothing while we all think about this. i agree with what everyone is saying, the question is what can we do about it? obviously the attorney general was able to get something out of them, it just isn't enough. it also was their first offer and the ag just passed it on to you. problem is what can you do? it's stupid to spend a ton just to get an extra 600 bucks. you know it, ans unfortunately... so do they. let all think about this over the weekend and see what we can think of

That really sucks sorry to hear that and if anybody can feel for you its me, but Jimmy is right you are lucky to be getting anything back and the legal system is a crap shoot so...just be thankful you didn't spend over $20,000 on a POS motor like I did with Rockford Racecraft, can't really say much more because the case is being appealed so until its over...I really hate seeing people getting ripped off...Best of luck...

sue them.
you can file small claims for cheap cheap money, in your home state.
think they'll want to send an attorney (scumbag) all the way to your state to defend a tiny claim they'll likely lose anyway?
restock fees never stand up in court anyway...
quit screwing around with the internet, listers, and call a lawyer, like any good american would.
after all, some fatshit got a million for dumping java on his crotch while driving....oj got off....and he's sure innocent!
seriously - don't you have a frined/family who made it thru law school?
the only thing anyone will pay attention to is the threat or reality of being served papers.
end of story.
